General Terms and Conditions

General terms and conditions of the online shop www.lepavida.si are written in line with the Consumer Protection Act and under the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes of e-commerce.

Online shop www.lepavida.si is managed by Matija Geržina s.p. (provider), the provider of e-commerce services. The website and online shop is open 24 hours a day, 7 days a week.

To order wine or any other product from www.lepa-vida.si you must be over eighteen years of age.
You must ensure that the details provided by you in communication with Lepa Vida, at any time are correct and complete.
You must inform us immediately of any changes to the information that you provided to us.

General terms and conditions deal with functioning of online shop www.lepavida.si, rights of consumer and business relations between provider and buyer.

Information availability
The provider will always provide the following information:
- the company's identity (name, address),
- contact information (e-mail, telephone),
- the main product's or service's characteristics
- product availability,
- the delivery conditions or conditions of service execution,
- prices have to be specified clearly and unambiguously with evident delivery costs and tax inclusion or exclusion,
- the way of payment and delivery,
- period of validity of the offer,
- the deadline of possible contract cancellation and its prerequisites,
- explanation of complaint proceedings, with contact information.

Products
We reserve the right to alter any product detail advertised without notice and while every effort is made to describe goods accurately in the advertisement no warranty is given as to accuracy and no responsibility will be accepted for error or mistake and any resulting loss.

Payment terms
Provider enables following payment possibilities:
-  PayPal (Email payments; accepts credit cards)
-  wire transfer (money transfer on the bank account of online shop www.lepavida.si – based on offer or proforma invoice)
Provider sends paper-based invoice or electronic (email) invoice with dissected expenses and instructions how to resign the contract and return the product if this is necessary and possible.

Prices
Online prices are valid for all customers.
All prices are exclusive of VAT, except if noted differently.
The prices are valid at the moment of order confirmation.
Despite our best efforts, a small number of the products may be mispriced. If the product's correct price is higher than our stated price, we will at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
The electronic purchase agreement between provider and buyer is made at the moment of order acceptance (the buyer gets confirmation of his order over email). From this moment on all prices and other conditions are fixed and are valid for both provider and buyer.

Buying procedure
1. Order overview: After ordering the buyer gets electronic confirmation (an email) about the order acceptance.

2. Order acceptance: Order goes to further processing when the provider reviews the order and checks availability of ordered products and accepts or with reason rejects it. The provider notifies the buyer about the delivery by e-mail. The purchase agreement between the buyer and provider is at this point irrevocably concluded.

3. Product shipment: The provider makes the product ready in stated delivery time, ships it an notifies the buyer by e-mail. The provider informs the buyer about return policy and who to contact in case of delivery delay or complaint.

Delivery
Every effort will be made to deliver on time, but any delivery day specified is a best estimate and no liability is accepted for any loss arising from delay or error in the delivery of the goods.
The provider accepts no liability for deliveries being missed due to non payment. It is the buyers responsibility to ensure that full payment is made before delivery can take place.
The provider reserves the right to choose any delivery service provider. In case of any other way of delivery agreement in advance is necessary.

Safety
The provider uses adequate technological and organizational means for transmitting and saving personal information and payments.

Data protection

The provider commits to the perpetual data protection of the user.
The provider will keep IP addresses of all visitors for undetermined period of time.
The provider will use all personal data only for order execution (sending information materials, offers and invoices) and other necessary communication.
User's personal data will not be impart to the unauthorised or third parties under any circumstances.

Communication
The provider will communicate with the buyer over long-distance communication means only if the buyer agrees to that.
Electronic advertising messages will include the following elements:
- they will be marked clearly and unambiguously as that,
- they will assure sender transparency,
- various sales, promotions and other marketing tools will be marked as that. All conditions of participation will be clearly specified as well,
- to stop receiving advertising messages the cancellation procedure will be clearly presented,
- user's wish not to receive advertising messages will be treated seriously and with all due respect.

Limitation of liability
Despite our best efforts some data can be incorrect or not up to date. In case of changed prices, delivery time or product's characteristics we will contact you for instructions before shipping or cancel your order and notify you of such cancellation.
The provider shall not be liable for any content on the website posted by visitors. The provider reserves the right to remove or edit unsuitable content.
The provider shall not be liable for products' photography. They are symbolic and don't ensure the products' characteristics.

Complaints and disputes
The provider respects the consumer protection legislation and tries to provide an efficient system of complaint processing. You can always contact us in case of any troubles. Send the complaint to our e-mail address #EM#636e6c7765667247646c7a6a7a646a6e3e627b#EM# and we will respond as soon as possible. The procedure of complaint processing is confidential.
The provider will make the best effort to solve all disputes consensually.

REFUND POLICY
Rights of cancellation, returns
If for any reason you are not satisfied with ordered products or want to resign from the contract, you may return it.
First please inform us about the cancellation within 8 days after product's receipt(by post or e-mail to #EM#636e6c7765667247646c7a6a7a646a6e3e627b#EM#). Clear explanation of your dissatisfaction with the product is neccessary.

Then you have to return the product within 30 days after the notice about resigning to our address (Matija Gerzina s.p., Osek 4b, SI-5261 Sempas, Slovenia).
Once we receive your return products  we will credit your original payment for the full purchase price or your replacement will be reshipped. Please allow 1-2 billing cycles for the credit to appear on your bill.

Damaged products
If we need to replace a wine due to damage in transit, please allow 1-2 weeks following receipt of your request for your replacement to arrive. Please help us deliver your order to the correct address by verifying delivery addresses carefully. Errors or changes in delivery instructions that incur additional charges will be passed on to you.

Guarantee
We want you to be completely delighted with our wines and service. If not, please let us know either over phone (+386 40 299 662) or email (#EM#636e6c7765667247646c7a6a7a646a6e3e627b#EM#). We will take care for the pickup of the bottle(s) and we will either send a replacement or give you credit or refund. It is important to us to analyse your complaint and wine in details so please save all the bottles and contents for pickup.

Important
- When you return the product to the provider under the warranty or refund, you have to submit a copy of the invoice.
- The address of the provider where you can send the products you want to return is Matija Gerzina s.p., Osek 4B, SI-5261 Sempas, Slovenia.
- We recommend you use a delivery service which enables tracking of the shipment. Products should be properly prepared for the transport.
- The costs of sending are always covered by the sender unless it's arranged differently.
